These Terms and Conditions (“Agreement”) govern the use of services offered by Cielo Travel (“Company,” “we,” “our,” or “us”) through our website cielo.travel and during travel and tourism activities provided directly or in collaboration with third-party partners. By registering, booking, or making a payment, the traveler (“you,” “your,” or “traveler”) declares that they have read, understood, and accepted these Terms and Conditions.
1. Scope of Services
Cielo Travel offers and arranges:
- Guided tours and excursions.
- Multi-city and package travel itineraries.
- Transportation and transfers.
- Hotel and accommodation reservations.
- Adventure and leisure activities.
- Digital marketing services related to travel and tourism.
Services may be operated directly by Cielo Travel or facilitated through third-party providers, including hotels, airlines, tour operators, and other service partners.
2. Booking, Payments, and Acceptance
- A booking is confirmed only upon receipt of payment and written confirmation from Cielo Travel.
- Payment must be made in full prior to the start of the service, unless otherwise agreed in writing.
- Cielo Travel accepts payments through authorized methods listed on our website. We are not responsible for losses due to unauthorized payment channels.
- Failure to complete payment on time may result in automatic cancellation, with no refund or credit due.
- By making a booking, the traveler accepts these Terms and Conditions and agrees to comply with all instructions, regulations, and safety guidelines provided by guides, operators, and partners.
- Cielo Travel reserves the right to decline or cancel any booking at its sole discretion.
3. Changes to Itineraries and Services
Cielo Travel reserves the right, in cases of force majeure or special circumstances, to:
- Modify itineraries.
- Change guides or service providers.
- Substitute accommodations, transportation, or activities.
In all cases, substitutions will be of equal or superior quality to the contracted services.
4. Traveler Obligations and Health Declarations
Travelers declare under their sole responsibility that:
- They are in good physical and mental health.
- They do not suffer from cardiovascular conditions, epilepsy, asthma, diabetes, schizophrenia, or other conditions that may endanger their participation.
- They are not pregnant, in recovery from recent surgery, or under medical rehabilitation.
- They do not wear medical or cosmetic prostheses that may be compromised during activities, or if so, they accept the risks involved.
- They are of legal age (18+) or have documented parental/guardian consent if minors.
- They will not participate under the influence of alcohol, drugs, or impairing medication.
- They will disclose in advance any medical condition or special requirement that may affect participation.
Travelers must follow all safety instructions, use provided equipment properly, and respect guides’ directions at all times. Failure to comply may result in exclusion from the activity without refund.
5. Conduct and Responsibilities
Travelers must:
- Behave respectfully toward guides, staff, fellow travelers, and local communities.
- Protect the environment and follow sustainability guidelines.
- Avoid reckless or unlawful behavior that could endanger themselves or others.
Cielo Travel will not be liable for consequences resulting from a traveler’s misconduct, negligence, or refusal to follow instructions.
6. Documentation Requirements
Travelers are responsible for ensuring they carry all required identification and travel documents, including passports, visas, medical certificates, and permits. For minors, responsible adults must present valid identification and proof of guardianship. Failure to comply may prevent participation, with no right to refunds or claims against Cielo Travel.
7. Liability Limitations
Cielo Travel does not assume responsibility for:
- Traveler negligence, misconduct, or disregard of instructions.
- Accidents or losses resulting from risky behavior.
- Weather conditions, strikes, political events, or force majeure.
- Services independently contracted by travelers with third parties.
- Loss, theft, or damage of personal belongings.
Cielo Travel recommends all travelers obtain adequate travel insurance, including medical and accident coverage.
8. Cancellations and Refunds
Cielo Travel applies strict cancellation policies:
- Day Tours and Single-Day Activities:
- 100% fee if canceled within 24 hours before the event.
- 75% fee if canceled within 3 days before the event.
- 50% fee if canceled within 7 days before the event.
- Multi-City Packages and Extended Journeys:
- 100% fee if canceled within 4 days before departure.
- 75% fee if canceled within 8 days before departure.
- 50% fee if canceled within 14 days before departure.
- Adventure Activities (e.g., paragliding, hot springs, amusement parks, extreme sports):
- 100% fee if canceled within 24 hours before the event.
- 75% fee if canceled within 4 days before the event.
Refunds, when applicable, will exclude administrative fees, bank charges, and non-refundable expenses already incurred by Cielo Travel or its partners.
9. Third-Party Services
When services are provided by third-party operators, the traveler acknowledges that:
- The operator is solely responsible for the provision of those services.
- Cielo Travel acts as an intermediary and is not liable for accidents, delays, losses, or inconveniences caused by third parties.
- Insurance policies of third-party providers may apply, subject to their terms and conditions.
10. Force Majeure
Cielo Travel shall not be held responsible for events beyond its reasonable control, including but not limited to natural disasters, pandemics, acts of terrorism, government actions, strikes, weather conditions, or technical failures.
11. Photography and Media Rights
By participating in tours or activities, travelers grant Cielo Travel the right to capture and use photographs, video, or audio recordings for marketing, promotional, and informational purposes, without compensation. Travelers may opt out by notifying the Company in writing before the activity.
12. Complaints and Claims
- Any complaint during a service must be immediately reported to Cielo Travel staff or guides to allow resolution.
- Claims submitted after the service must be made in writing within 10 calendar days of the completion of the trip.
- Failure to raise issues within this timeframe releases Cielo Travel from liability.
13. Intellectual Property and Website Use
- All website content, including text, photos, itineraries, and branding, is the exclusive property of Cielo Travel.
- No material may be copied, reproduced, or used without prior written authorization.
- The website may only be used for lawful purposes and legitimate bookings. Fraudulent or unauthorized use will result in termination and possible legal action.
14. Severability and Waiver
- If any provision of these Terms is held invalid, the remaining provisions remain in full force and effect.
- Failure by Cielo Travel to enforce any right or provision shall not constitute a waiver of such rights.
15. Special Disclaimer for Adventure Activities
Travelers acknowledge that certain activities (including but not limited to paragliding, rafting, mountain excursions, and amusement parks) involve inherent risks. By participating, travelers:
- Accept full responsibility for their decision to engage in such activities.
- Waive liability against Cielo Travel for injuries, damages, or losses arising from participation, except where prohibited by law.
- Agree to use all safety equipment provided and follow all instructions.
16. Governing Law and Jurisdiction
This Agreement is governed under a dual legal framework:
- For online bookings, payments, and contractual matters, the governing law is that of the State of Texas, United States of America, and disputes shall be resolved in the competent courts of Frisco, Texas.
- For services physically carried out in Colombia, the governing law is that of the Republic of Colombia, and disputes shall be resolved in the competent Colombian courts.
17. Amendments
Cielo Travel reserves the right to amend these Terms and Conditions at any time. Updates will be posted on our website with a revised “Effective Date.” Continued use of services constitutes acceptance of updated terms.
